Services
By purchasing the services of Cirious Media Inc. as a Client,
you agree to be legally bound by these Terms and Conditions,
including those terms and conditions incorporated by reference.
If you do not accept these Terms and Conditions stated here
without modification, you may not use the services provided
by Cirious Media Inc.. Cirious Media Inc. may modify these
Terms and Conditions at any time.
All prices listed on CiriousMedia.com are in US Dollars.
All work must be paid in advance prior to any design work
commencing. Clients purchasing Cirious Media Inc.’s Service
must pay for the Service online via credit card or offline
via telephone, certified check or money order. If you pay
by credit card, you will be required to provide a valid
credit card number and your credit card billing address
when you register as a Client. Cirious Media Inc. will email
the client a receipt for the transactions in which Client
is involved.
Ownership
All final artwork become the property of the Client, having
unlimited and royalty-free use of the artwork upon payment
of all fees. Cirious Media Inc. retains the right to display
the artwork in their portfolio and advertising materials.
Client Security
Cirious Media Inc. will take appropriate steps to prevent
unauthorized access, maintain data accuracy, and ensure
the correct use of the information you provide us. Whenever
you give Cirious Media Inc. sensitive information, Cirious
Media Inc. will take reasonable steps to establish a secure
connection with your web browser. Credit card numbers are
used only for payment processing.
Disclaimer
The Client unconditionally guarantees that any element of
text furnished to Cirious Media Inc. for inclusion in the
design samples do not infringe on any copyright or
trademarks that have been already established by another
organization. The Client will hold harmless, protect, and
defend Cirious Media Inc. and its subcontractors from any
claim or suit arising from the use of such elements
furnished by the Client.
Cirious Media Inc. guarantees the artwork provided to clients
are uniquely created by Cirious Media Inc. By purchasing
the services of Cirious Media Inc., the Client understands
the artwork provided may resemble a copyright image. Should
a case as this arise, Cirious Media Inc. will re-design
the artwork.
Eligibility Requirements
By registering as a Client, you represent and warrant that
the information you include as part of the registration
process is complete and accurate and, if you are registering
on behalf of an entity, that you are authorized to bind that
entity to these Terms and Conditions. Cirious Media Inc. may
accept or reject your registration in its sole discretion.
Termination
Cirious Media Inc. reserves the right, in its sole
discretion, to terminate Client’s access to all or a portion
of the Service, at any time, with or without notice. In the
event of such termination, Cirious Media Inc. will work with
Client to determine the amount of any refund (if any) to be
paid to Client as a result of such termination. Should
Client’s use of the Service result from Client’s material
breach of the terms and conditions of this Agreement, Client
shall not be entitled to any refund, unless otherwise
mutually agreed upon by the parties.
Operation of Web Site
Cirious Media Inc. shall not be responsible for any delays,
interruptions, errors, omissions the may occur on the Web
Site. Cirious Media Inc. reserves the right, but shall not
be required, to correct any delays, interruptions, errors or
omissions. Various circumstances may prevent or delay
availability of the Web Site, therefore, Cirious Media Inc.
makes no representation, warranty or covenant that the Web
Site or Service will be available at all times or at any
time. Cirious Media Inc. shall not be responsible for any
loss, cost, damage or liability that may result.
Use of Materials
The right to download and store or output the materials
in our site(s) is granted for the user's personal use only,
and materials may not be reproduced in any edited form for
commercial purposes. Any other reproductions, transmission,
performance, display or editing of these materials by any
means mechanical or electronic without the express written
permission of us is strictly prohibited. Users wishing to
obtain permission to reprint or reproduce any materials
appearing on these sites may email us at the support ciriousmedia.com.
Opting-out
At any time while assessing our site(s), any user while
